@SenLummis @XPROGTDBN28 I’m sorry, Cynthia, but you and I can both see the almighty loophole ready to be exploited by the Trump family. Namely, though there are prohibitions on spouses, the children of Presidents etc. are not under scrutiny. How convenient, one might say. I can imagine how unacceptable

High attention and emotional sentiment detected.
The CLARITY Act ethics provision bans all federal officials from issuing or sponsoring digital assets for profit. That list names the President, the Vice President, and their spouses. Officials can still invest in or hold crypto, according to summaries of the bill.
Sen. Cynthia Lummis announced the deal on Wednesday. She framed it as a voluntary standard the President chose to accept. The agreement clears what negotiators called the final hurdle before a possible Senate floor vote.
The rule targets one specific act. It stops officials from creating, launching, or sponsoring a token for personal gain. So a sitting president could not issue a new coin and pocket the proceeds.
The ban does not touch passive holdings. Officials may still buy, hold, or invest in digital assets. In short, the line sits between profiting from issuance and simply owning crypto.
Enforcement runs through the Department of Justice. Lummis described it as backed by “real enforcement and real penalties.” Still, the summaries released so far do not spell out exact penalty amounts.
The provision also reaches spouses. However, the current summaries do not detail whether it covers children or other relatives. That gap will likely need rulemaking to settle.
The provision comes with an expiration date. The text states the rule “will have no force and effect on and after noon on January 20, 2029.” That moment marks the end of the current presidential term.
Supporters read the sunset as proof of intent. In their view, Trump chose a standard for himself rather than one Congress forced on him. Lummis pushed that framing directly.
According to a fact sheet quoted by The Block, the sunset “underscores that this is a standard President Trump chose to hold himself to, not one Congress imposed on him.” Critics see the same clause very differently.
The fight traces back to the Trump family’s own crypto ventures. Those projects turned an abstract ethics debate into a concrete one.
The family launched the $TRUMP memecoin on Solana in January 2025. World Liberty Financial, or WLFI, followed as a linked project. Its USD1 stablecoin then arrived in March 2025 through a tie-up with BitGo.
Democrats seized on those launches for more than a year. Senators including Kirsten Gillibrand, Ruben Gallego, and Angela Alsobrooks pressed for language barring officials from profiting through token issuance. July 1 disclosures reportedly showed more than $1.4 billion in Trump crypto-related income.
The White House resisted any rule that singled out one family. Instead, it pushed for an across-the-board standard. As a result, the final text applies to every federal official rather than to the President alone.
The path to Wednesday’s text ran through months of stalled talks. The ethics language was the sticking point every step of the way.
On May 14, Senate Banking advanced the bill on a 15-9 vote. Only two Democrats backed it, and an ethics amendment failed along party lines. Negotiations then dragged through June and July.
Trump met with GOP senators on July 16 to work through the remaining issues. The White House reached the ethics agreement on July 21, per reporting from Brave New Coin. The combined Banking and Agriculture text landed the next day.
Key milestones in the CLARITY Act & Trump Crypto Ethics Saga
Trump family launches $TRUMP memecoin; WLFI project becomes active, setting the stage for later ethics disputes.
USD1 stablecoin launches via WLFI and BitGo, expanding Trump family’s direct financial stake in the crypto sector.
Gillibrand, Gallego, Alsobrooks, Warren, and others repeatedly push for ethics language barring officials from profiting via crypto issuance or sponsorship — prior bills stall each time.
Senate Banking Committee advances the CLARITY Act with only two Democratic votes. Ethics amendment fails along party lines.
July 1 financial disclosures reveal ~$1.4B+ in Trump crypto-related income. White House pushes for across-the-board ethics rules, rejecting any language targeting specific individuals.
Trump huddles with Republican senators to address outstanding sticking points on the bill ahead of a potential floor vote.
White House strikes an ethics agreement with negotiating parties, clearing a key obstacle to advancing the combined bill.
Updated bill text drops with ethics provision and sunset clause included. Sen. Lummis tweets in support, signaling momentum toward a Senate floor vote.
Not everyone buys the “higher standard” framing. Ethics watchdogs and several Democrats call the provision weaker than it looks.
Their first concern is the sunset itself. Because the rule expires in January 2029, they argue it fails to bind future conduct. Their second concern is the enforcement route.
The Department of Justice would handle any case. Yet the Attorney General serves at the President’s pleasure. Skeptics also note the absence of state attorney general enforcement, which could add independent teeth.
Supporters counter that the ban is real and the penalties are meant to bite. They also point out that the earlier bills carried no such rule at all. The debate now shifts to the Senate floor.
The new text sets up a possible floor vote before the August recess. Passage is far from guaranteed, though. The bill still needs support in both chambers before it can reach the President’s desk.
Several questions remain open. The exact statutory penalties, the treatment of pre-existing holdings, and the precise meaning of “sponsoring” all await clarification. Readers should watch the full bill text and any Senate floor action for those details.
For now, the CLARITY Act ethics provision stands as the deal that unblocked the wider bill. Whether it survives the floor intact is the next thing to watch. None of this is financial advice.
