Ethereum-based gaming network Xai has filed a lawsuit against Elon Musk’s AI company xAI, accusing it of trademark infringement, unfair competition, and reputational harm.
The filing claims Musk’s xAI has caused significant marketplace confusion especially after announcing plans for a gaming studio.
The complaint says consumer and media confusion intensified when Musk announced xAI’s gaming studio. Even Musk’s AI chatbot, Grok, reportedly misattributed projects, linking Xai to Musk’s company.
Ex Populus argues that Musk’s involvement has worsened sentiment toward Xai’s brand. They claim Musk’s polarizing image and controversies have led to “significant negative consumer sentiment” toward the Ethereum gaming network.

According to the lawsuit, Musk’s lawyers tried to pressure Ex Populus into surrendering trademark rights earlier this month. The USPTO has already suspended several xAI trademark applications, citing a high likelihood of confusion with Xai’s mark.
